These Terms of Service (“Terms”) govern your use of the Twelve27 Souvenirs website and the products and services we make available through it. Please read them carefully. By browsing this website or submitting an inquiry, you agree to these Terms.
1. Who we are
Twelve27 Souvenirs sells apparel, accessories and souvenirs inspired by the Dominican Republic. Our business is based at C. Maria Montes 15, Sosúa, Puerto Plata, Dominican Republic. In these Terms, “we”, “us” and “our” refer to Twelve27 Souvenirs, and “you” refers to the person using the website.
2. How ordering works
This website is a product catalogue and inquiry service rather than a self-service checkout. We do not process payments on the website. Instead:
- You browse the catalogue and select the product you are interested in.
- You submit a product inquiry using the inquiry form on the product page, or contact us through our Contact page.
- We reply with current pricing, availability, lead times and payment options.
- An order exists only once we have confirmed it with you in writing and agreed the price, quantity and delivery arrangements.
Submitting an inquiry does not create a contract of sale, does not reserve stock, and places no obligation on either party until we confirm the order.
3. Product information, pricing and availability
We work to keep product descriptions, images and specifications accurate, but we do not warrant that they are complete or error-free. Colours and finishes may differ slightly from what appears on your screen, and handmade or hand-finished items naturally vary between pieces.
Where a price is shown, it is indicative and may change before an order is confirmed. Items marked “Coming Soon” are not yet available to order. All products are subject to availability, and we may withdraw or change any product at any time.
4. Quotations
Unless we state otherwise in writing, a quotation we give you in response to an inquiry is valid for 30 days from the date we send it, and may be revised if your requirements change, if supplier costs change materially, or if the quotation has expired.
5. Payment
Payment terms, accepted payment methods and any deposit required will be confirmed in writing as part of your order. Custom, personalised and bulk orders may require payment in advance or a non-refundable deposit; we will always tell you before you commit.
6. Delivery, shipping and collection
Delivery costs, carriers and estimated timescales are confirmed with your order and depend on the destination, weight and value of the goods. Any delivery date we give is an estimate and not a guarantee. We are not liable for delays caused by carriers, customs clearance, weather, or other circumstances outside our reasonable control.
Where goods are shipped internationally, you are the importer of record and are responsible for any import duties, taxes and customs charges levied in the destination country. These are not included in our prices unless we say so in writing.
7. Cancellations, returns and refunds
If you need to cancel or return a confirmed order, contact us as soon as possible. Returns are handled case by case according to the terms confirmed with your order and applicable Dominican Republic consumer law.
Custom-made, personalised and made-to-order items generally cannot be cancelled or returned once production has started, except where the goods are faulty or not as described.
If goods arrive damaged, faulty or not as described, tell us within 14 days of receipt and include photographs where possible so we can put it right.
8. Acceptable use
You agree not to:
- use this website for any unlawful or fraudulent purpose;
- submit false, misleading or automated inquiries, or use the inquiry form to send unsolicited or bulk messages;
- attempt to gain unauthorised access to the website, its server, or any connected system;
- interfere with the normal operation of the website, including by introducing malicious code or placing unreasonable load on it;
- copy, scrape, republish or resell any part of the website or its content without our written permission.
9. Intellectual property
All content on this website — including text, product photography, graphics, logos, designs and the Twelve27 Souvenirs name — is owned by us or our licensors and is protected by copyright and trade mark law. You may view and print pages for your own personal, non-commercial use. Any other use requires our prior written consent.
10. Third-party links and services
This website may link to third-party websites and use third-party services. We do not control those sites or services and are not responsible for their content, availability or privacy practices. Any dealings you have with a third party are between you and that third party.
11. Availability of the website
We aim to keep the website available but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the website for maintenance, updates or business reasons, and we will try to give reasonable notice where we can.
12. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.
Subject to that, and to the maximum extent permitted by law: the website and its content are provided “as is”; we exclude all implied warranties; and we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data arising from your use of the website. Our total liability in connection with any confirmed order is limited to the amount you paid for the goods in question.
13. Indemnity
You agree to indemnify us against any claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the website.
14. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
15. Changes to these Terms
We may update these Terms from time to time. The version published on this page is the version that applies, and the “Last updated” date at the top shows when it last changed. Your continued use of the website after a change means you accept the updated Terms. The Terms that apply to a confirmed order are those in force when we confirmed it.
16. Governing law
These Terms and any dispute arising from them are governed by the laws of the Dominican Republic, and the courts of the Dominican Republic have exclusive jurisdiction, unless local consumer law gives you the right to bring proceedings elsewhere.
17. General
If any provision of these Terms is found to be unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These Terms are between you and us; no one else may enforce them.
